AI Generator provides AI-powered content generation services using advanced AI technology. Our services include but are not limited to:

3. Account Registration and Security

5. User Content and Intellectual Property

5.1 Your Content Ownership

You retain all ownership rights to content you create, upload, or generate using our Service ("User Content"). This includes text prompts, uploaded images, and generated outputs.

5.2 License Grant to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. We will not use your content for AI model training without your explicit consent.

5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to upload and share your content, and that your content does not infringe any third-party rights.

5.4 Prohibited Content

You may not create, upload, or share content that:

• Violates laws or regulations
• Infringes intellectual property rights, privacy rights, or other rights
• Contains hate speech, harassment, or promotes violence
• Depicts illegal activities, child exploitation, or non-consensual content
• Contains spam, malware, viruses, or harmful code
• Impersonates individuals or entities
• Constitutes misinformation or deepfakes intended to deceive

We reserve the right to remove prohibited content and suspend accounts that violate these restrictions. Violations may be reported to law enforcement.

6. Paid Services and Billing

6.1 Subscriptions and Fees

Certain Service features require paid subscriptions. All fees are in U.S. dollars unless otherwise stated. Current pricing is available on our pricing page. Fees are non-refundable except as expressly stated in our refund policy.

6.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for providing accurate payment information and maintaining sufficient funds.

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate. You can manage or cancel subscriptions in your account settings.

6.4 Credits System

Our service uses a credit-based system where different generation tasks consume different amounts of credits. Credit costs vary by output quality, duration, and complexity. Unused credits expire according to your plan terms.

6.5 Refund Policy

We offer a 30-day money-back guarantee for first-time subscribers. If you are unsatisfied within 30 days of your initial purchase, contact us for a full refund. Subsequent subscription fees and credit purchases are non-refundable. Refunds are processed to the original payment method.

6.6 Price Changes

We reserve the right to change pricing at any time. Price changes for subscriptions will take effect at your next billing cycle. We will provide at least 30 days' notice of significant price increases.

7. Intellectual Property Rights

The Service and all its contents, features, functionality (including software, text, displays, images, video, audio, design, selection, and arrangement) are owned by MindVideo, our licensors, or other content providers and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used without our prior written permission. Third-party trademarks are the property of their respective owners.

8. AI-Generated Content Disclaimer

Content generated by our AI models may be unpredictable and is provided "as is." We do not guarantee:

• Accuracy, quality, or suitability of AI-generated outputs
• That generated content is free from errors or artifacts
• That outputs will meet your specific requirements or expectations
• That generated content is original or non-infringing (though we train models responsibly)

You are responsible for reviewing, editing, and ensuring the appropriateness of AI-generated content before use. We recommend adding watermarks or disclosures when publishing AI-generated media.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the Service
• Warranties that defects will be corrected or that the Service is free of viruses or harmful components

Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MindVideo, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Loss of goodwill or reputation
• Service interruptions or data loss
• Cost of substitute services
• Any other intangible losses

Whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to liability, or $100, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless MindVideo, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and representatives from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your User Content or any content you submit, post, or transmit through the Service
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of applicable laws or regulations

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

12.3 Arbitration Agreement

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law. You may opt out of arbitration within 30 days of account creation by emailing [email protected].

12.4 Class Action Waiver

You agree to bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service. Changes become effective 30 days after posting, unless otherwise stated.

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to changes, you must discontinue use and cancel your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindVideo regarding the Service, superseding all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet/utility failures.
