1. Acceptance of Terms

Welcome to AI Generator ("Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you and AI Generator ("we," "us," "our").

By accessing or using our AI Video Generator and AI Image Generator services, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Service.

2. Service Description

AI Generator provides AI-powered content generation services using advanced AI technology. Our services include but are not limited to:

• Text to Video: Generate videos from text descriptions
• Image to Video: Animate static images into dynamic videos
• Text to Image: Create images from text prompts
• Image to Image: Transform and enhance existing images
• Cloud Storage: Store and manage your generated content
• CLI Access: Start generations from a terminal or an agent with your account key
• Technical Support: Customer service and assistance

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service.

3. Account Registration and Security

3.1 Account Creation

To access certain Service features, you must create an account. You must provide accurate, complete, and current information during registration. You are responsible for maintaining the accuracy of your account information.

3.2 Account Security

You are responsible for maintaining the security and confidentiality of your account credentials. You are liable for all activities that occur under your account. If you discover unauthorized use of your account, notify us immediately at [email protected].

3.3 Age Requirements

You must be at least 13 years old to use our Service. Users under 18 must have parental or legal guardian consent. By using the Service, you represent and warrant that you meet these age requirements.

3.4 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities. You may delete your account at any time through your account settings or by contacting support.

4. Usage License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial purposes in accordance with our pricing plans.

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer, decompile, or attempt to extract source code
• Remove, alter, or obscure any proprietary notices
• Use the Service for any illegal, harmful, or unauthorized purpose
• Interfere with or disrupt Service servers or networks
• Use automated systems (bots, scrapers) to access the Service without permission
• Circumvent usage limits, rate limits, or access controls
• Resell or redistribute Service outputs without proper licensing
• Use the Service to generate harmful, illegal, or infringing content

5. User Content and Intellectual Property

5.1 Your Content Ownership

You retain all ownership rights to content you create, upload, or generate using our Service ("User Content"). This includes text prompts, uploaded images, and generated outputs.

5.2 License Grant to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. We will not use your content for AI model training without your explicit consent.

5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to upload and share your content, and that your content does not infringe any third-party rights.

5.4 Prohibited Content

These rules apply to prompts, uploaded source material, and generated or edited outputs across our services, including Text to Video and Image to Video, whether accessed through the website or an available API. Attempts to bypass content safety controls are also prohibited.

You may not create, upload, or share content that:

• Contains pornography, sexually explicit or adult sexual content, or other sexual NSFW content, including sexual acts, genital exposure, nudity intended for sexual arousal, and non-consensual sexual imagery; sexual content involving minors is strictly prohibited
• Violates laws or regulations
• Infringes intellectual property rights, privacy rights, or other rights
• Contains hate speech, harassment, or promotes violence
• Depicts illegal activities, child exploitation, or non-consensual content
• Contains spam, malware, viruses, or harmful code
• Impersonates individuals or entities
• Constitutes misinformation or deepfakes intended to deceive

We reserve the right to remove prohibited content and suspend accounts that violate these restrictions. Violations may be reported to law enforcement.

5.5 Reporting Prohibited Content

Report suspected violations to [email protected] with the subject “Content violation report”. Include the content URL or generation task ID if available, when you encountered it, and why it may violate these rules. Include a reply email so we can follow up. Do not download, reproduce, or attach illegal material; provide its location or identifier instead.

A staff member will provide an initial response within 1 business day of receiving the report. Reviews are normally completed within 7 business days. If more information or a longer investigation is needed, we will explain the reason and provide an updated expected completion time.

5.6 Content Review and Enforcement

• We record the report, check whether the content can be located, and assess urgency. Reports involving child safety, non-consensual sexual content, or a credible risk of imminent harm receive priority.
• A staff member reviews the reported content, relevant prompts or source material where available, and supporting information against these rules. We may ask the reporter or creator for additional context before deciding.
• For confirmed violations, we require the creator to stop the prohibited use and remove or correct the content. We remove or disable access to violating content under our control. Serious or repeated violations may lead to account action under Section 3.4, and suspected illegal activity may be referred to the appropriate authorities.

We notify the reporter of the review outcome to the extent permitted by privacy and legal requirements. Report information is limited to those who need it for review, enforcement, or legal obligations. If you believe a decision is incorrect, reply to the same email with the report reference and additional information to request reconsideration.

6. Paid Services and Billing

6.1 One-time credit purchases

Prices are listed in USD unless otherwise stated at checkout.

6.2 Payment Processing

Checkout displays the payment providers and methods currently enabled for your purchase. The site supports Stripe and Waffo. You authorize only the amount shown for the purchase you confirm.

6.3 One-Time Purchases

Credit packages are one-time purchases. There are no monthly or annual subscriptions, automatic renewals, or recurring charges. Each additional purchase requires a separate checkout.

6.4 Credits System

Generation consumes credits according to the selected model, resolution, duration, and other settings. Check the credit cost shown in the generation form before submitting a task.

Purchased credits do not expire. Unused credits remain in your account without requiring another purchase or an active subscription.

Promotional credits, when offered, appear in your account with their terms.

6.5 Refund Policy

For your first credit purchase, you may request a full refund within 7 days of purchase if the purchased credits are unused. Once you have used the service and consumed credits, the purchase is not refundable. We do not offer partial refunds.

This policy does not limit mandatory consumer rights or remedies under applicable law. The 7-day first-purchase offer is our voluntary refund policy.

An approved full refund removes the credits associated with that order, up to your available balance. Your balance cannot fall below zero. We do not record debt or deduct any unrecovered credits from later purchases.

6.6 Price Changes

Prices may change for future purchases. The amount displayed at checkout applies to the purchase you confirm; a later price change does not alter completed orders. We provide at least 30 days' notice of significant price increases.

7. Intellectual Property Rights

The Service and all its contents, features, functionality (including software, text, displays, images, video, audio, design, selection, and arrangement) are owned by AI Generator, our licensors, or other content providers and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used without our prior written permission. Third-party trademarks are the property of their respective owners.

8. AI-Generated Content Disclaimer

Content generated by our AI models may be unpredictable and is provided "as is." We do not guarantee:

• Accuracy, quality, or suitability of AI-generated outputs
• That generated content is free from errors or artifacts
• That outputs will meet your specific requirements or expectations
• That generated content is original or non-infringing (though we train models responsibly)

You are responsible for reviewing, editing, and ensuring the appropriateness of AI-generated content before use. We recommend adding watermarks or disclosures when publishing AI-generated media.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the Service
• Warranties that defects will be corrected or that the Service is free of viruses or harmful components

Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AI Generator, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Loss of goodwill or reputation
• Service interruptions or data loss
• Cost of substitute services
• Any other intangible losses

Whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to liability, or $100, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless AI Generator, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and representatives from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your User Content or any content you submit, post, or transmit through the Service
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of applicable laws or regulations

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

12.3 Arbitration Agreement

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law. You may opt out of arbitration within 30 days of account creation by emailing [email protected].

12.4 Class Action Waiver

You agree to bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service. Changes become effective 30 days after posting, unless otherwise stated.

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to changes, you must discontinue use and cancel your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Generator regarding the Service, superseding all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet/utility failures.
